How to replace Homeowners Association Management Company? I think the Management company that runs our complex is horrible. They need to be replaced for many reason I will not get into and I am sure that others who have had problems with them feel the same. Complex is very large. I don't belong to the committe and know the association group likes the management company. Is there any way to have them replaced? Any advice please. I am an owner but not involved with the association. The people who go to the meetings like the management company, unfortunately.
How do you change a townhouse management association? As one of many townhouse owners who want to change the management company who does not provide the customer service nor do the job that we as owners pay them to do with our monthly HOA fees. I couldn't find anything thing specifically in the HOA bylaws. Any ideas besides writing to the owners on tax records and ask them to meet and vote?

LIBA vs MMA (Madras Management Association) - which is better? Dear friends, I am planning to take up a short term course in HR Management. Now both these institutes (LIBA & MMA) are offerring this 3 month course and the admission is currently under way in both these institutes. how to deal with unjust condo management association? We live in a Condominium in ohio, and when we bought it the outside patio wall (brick wall structure) had a huge crack and has about a half inch gap between our wall and the neighbors wall. the crack was filled in with cement. Over the summer the management association decided to repave the street, due to all the vibrations from destroying the old concrete, the top row of bricks in the patio fell to the ground as well as well as the concrete in the crack. we contacted the association to fix it and they sent out a brick layer, who wanted to redo the repair as it was done before. we refused the repair because it would ultimately fall again and probably on one of our kids. The assocation sends us a letter from an attorney that stated that we broke the wall and we sent away the repair man thus they aren't fixing it and we owe them the attorney fees ($500 FOR ONE LETTER!!!). the management people are a bunch of control freaks who wont negotiate and hide behind lawyers (Which they are hiring out of our pocket) Our neighbour had a similar issue and hired a lawyer and he couldn't win the case. How can we deal with such assholes?

we are homeowners in an association and want to sign a petition getting rid of the fees what should we do? we are a neighborhood not a condominium. there are 407 homes and almost 80% want to get rid of the fees because the management association does not keep up what needs to be done. for example, they do not bring people before the covenants committe who have continually ignored requests to adhere to the guidlines, they dont keep up with inspections, the board members for a year now have discussed purchasing blinds for the clubhouse and still we have no blinds. they can't seem to get anything accomplished and we are tired of paying fees and receiving no services or even adequate services. we inquired about signing a petition and they told us that in order to get rid of the association it would require 66 and 1/3 % of the homeowners AND that each homeowner(s) mortgage company must agree as well. does the mortgage company have anything to do with your association, all they require is that you pay your mortgage. help please...we are tired of the bull s h i t! if it helps any I live in suffolk virginia we have also voiced our concearns about the management company. every year someone new is appointed as manager and then we have to go through everything all over again. we want the management company fired but the board says because we have a contract we must wait there contract out. not so I believe. we hired them, they work for us and if they are not performing their jobs according to the contract dont we have the right to terminate their services?

Restaurant workers are generally poor people, minorities and teenagers, and the workers, according to a recent study, are among the most prolific users of recreational drugs by industry. It seems to me that the NRA is more of a PAC for upper-level management to donate money (which the average restaurant worker does not have) to Republican candidates to advance their pro-business, anti-worker agenda, rather than an actual organization of people in the restaurant industry - despite the reference to the 13 million US restaurant workers on their website. What do you think?
Should I sue the building management or association?? I own a condo and it has a management company and an association. I park my cars down in our garage and my cars are always parked dead centered in the space allocated to me. But recently between this Monday night and Thursday (Today), I found a scratch that was left by other residents trying to cut corners in the garage and thus scratched my car. I'm not sure if the owner will come step up and take the responsibility and the building management isn't doing much to help and kept saying the association is not liable for damages. What can I do?? I own these spaces and these people are trespassing into other people's properties why trying to cut through the parking spaces. BTW, my car is two month old so I baby it a lot. I do that to most of my cars and this is making me extremely upset.
Another Florida Slumlord Condo Management Association, should I take legal action? Owning my Miami condo is ruining my life! I can't get my condo association to make repairs that they have already agreed to do. I have a giant hole in my bathroom ceiling from a leak. The other repairs they did 6 years ago are extremely shoddy and will hurt the value of my property. I also can't rent the apartment until they have repaired the bathroom. The company has caused me non-stop stress since I bought my condo, and I'd really love to be able to affordably sue, or at least scare the crepe out of them! I just worry that they'll retaliate by turning down tenant and buyer applications in the future, because they are evil. Any advice would be greatly appreciated. FL Real estate lawyers??
How does one get control of a Homeowner Association? I live in a neighborhood that was established in 2002. Currently, 460 of 500 homes have been completed. Our covenants state that the developer has 5 votes per lot, while the homeowner has 1 vote per lot, and the association is eligible to be run by the homeowner upon majority of votes (which we now have). The developer turned the association over to a management company about a year & a half ago. This company has not performed to the satisfaction of the residents, and we would like control of the association. However, the management company said they would not consider turning over the association until ALL houses had been sold. Question: What steps should we take to "force the issue"? I am currently considering: 1. Calling a neighborhood meeting. 2. Collecting signatures (of intent to assume the association). 3. Soliciting a list of candidates for a transition committee (or for a board of directors). Is there a legal process?
What it the best solution for dealing with a troublesome neighbor and a condo association? I rent a nice condo in a perfect location. But, the serenity is breached by some neighbor who is complaining about everything that happens here. A few people make a loud party. A car whose license plate is 2 days out of date is pointed out to a local police office and ticketed. The complaints never stop. I have always been nice to everyone who live around here. In addition, the condo association's management company is busy writing my landlord every time that this woman breathes. What do I do?
My Homeowners Association (HOA) is switching management My Homeowners Association (HOA) is switching from a property management company to nominate residents within the neighborhood to run it. The residents (besides myself) already decided who they want for President, Treasurer, etc. The "President" has been writing up his own rules that he would like in place. These rules are very unjust and I would not like to see these rules take place because they are specifically written against anything I do in my unit/townhome. What happens if I do not agree with these bylaws and do not sign an agreement to accept the new bylaws? Of course they are voting. But when the new bylaws take effect I will not sign any agreement. You must understand that my neighborhood was once 55+. The units had trouble selling so the management company had removed the 55+ rule. I then moved into the neighborhood and was immediately a target for being only 24 years old. Even rules that didn't exist were suddenly fabricated and I had challenged them and won because they weren't even in the bylaws book.
If we decide to go with a management service, must we still have a BOD at our association.? Our BOD"s in our condo association are stepping down and we don't have anyone ( except myself) to fill their roles for we need 3 people, so we decided to go with a management service. Now the wanna be president who never did anything in 3 years tells us the management company she acquired for us says we do not need a board of directors. Do you trust Utility Management Association to install foil barrier in a 1,100sq ft. for $4,000.00? We had a free dinner at a restaurant earlier. And he talked about what UAM is, and showed us the foil barrier, powerchill, etc.. He came over, gave us an estimate to place in the foil barrier, wrap around the water heater and put in a more efficient showerhead, all for a total of $4,000.00. We paid up front via Credit Card through payments first before they start coming over sometimes next week. Do you trust UAM, and would you go for it at that price?
Can a townhome association forclose on a townhome for non payment of association dues? The association and the management company do not have a financial interest of ownership of the property. The homeowner is NOT behind on their mortgage payments. The homeowner is behind on their association dues. My understanding is the mortgage company has first lien position and therefore the only recourse for the association is they can apply a lien to the property and collect the back dues when the property is sold. The association President tells me they have forclosed on 3 other propereties. Is this legal?

What happens to the lease when a property management company drops the owner as a client in Florida? I was just informed that my property management company is canceling their contract with the owner of my apartment. What does this mean for the rental agreement since it refers specifically to the property management company as the landlord? Apparently the owner has not been paying them. Homeowners association keeps knit picking my yard, should I get a lawyer? The management company for our homeowners association keeps sending me letters saying my yard is in need of maintenance. The one last month said to remove weeds in the driveway which I did. Now they sent me a registered letter telling me that I was being charged $15 for the letter and if it is not fixed in a month they will take legal action. The said I can request a hearing. What recourse my subdiivision have against the homeoener association company hired by the builder? I stay in a subdivision that has been built from 2003 to 2005. The subdivision is a collection of townhomes. Last night we had an annual "homeowner association" meeting even thought the HOA is being adminsitered by some managament company and not by memebers of the subdivision residents. The builder claims, we will get control of the HOA when 75% of the units in the subdivision have been sold. This arrangement would be ok IF we, the residents, have someone way to force the HOA management company to address the community's concerns, regarding landscaping, installation of street signs, etc. Howver, the HOA company says nothing can't really be done until the HOA control is given over to the subdivision residents which won't happen until, 75% of the subdivision untis are sold, which the builder claims only 66% has been sold. What to do because why are we paying some company for non-servivce?
I need legal help in regards to a neighborhood association problem? I had an affair with a guy in the neighborhood. The news has come out. My husband and I are still together. We are good but the neighborhood has been up and down. They of course are mutual friends so it has been tough. People gossip and that is fine. My problem now is this: This guy used to be the president of our homeowner's association. He quit after the affair came out, but before our close neighborhood friends knew. He chose to share personal information with a man who works as a security person at our clubhouse. He used him because he knew he was talking to someone who was in contact with me. This guy works for the community. Do I call the property management company and let them know? Also this guy I had the affair with is now running for the board of directors. He thinks since everyone is fine with it why not. Won't people question why he quit in the first place, and what about the fact that he has now got someone else involved that will probably get fired? Seems to me after the first answer as with all there is a double standard. I am considered a whore and this man is a stud in the neighborhood.

How do we determine if a property management company is negligent? The pipes in our association are rusty and bursting without notice. Sewage backs up into my unit. I submitted receipts for my loss of sheets, towels, and rugs. I asked that the rusted/corroded pipes be replaced six months ago. A piece of pipe was saved and there is only about 2mm space for water to pass through. I made a request this month that my things be replaced, and the pipes to be fixed. The property managment company said the board denied everything and will not replace my pipes until they burst. I could not believe he put this in writing. Is this negligence if they know they are rusted, a health hazzard and are intentionally not going to fix the problem while it is small?
Can we sue condo association for pitbull dog negligence? Can we sue condo association if we get hurt by a pitbull dog? The association has rejected our petition and will not ban or order muzzles for several pit bull dogs in our community. One of the dog has already caused $1,500 injury to a small dog. Home Owner Association HELP please? I live in Austin Texas and my home association is Alliance association management...I seriously believe whoever is in charge of maintenance has something against me and my family...We have receive many lawn violation notices which I feel was wrong !!! I check the notice and it state on a specific date it was noted that our lawn was in violation...but this noted date was after I just mow the damn lawn !!!!! Our recent notice states '' it was noted on 8/26/08 that the paint on your garage doors does not match the paint of the house.'' My house have red bricks and a white garage door. This house is like every other red brick house in the community which has a white gar. door !! I have never heard of a red garage door....this house was built this way we made no changes. All these rules are from the Declaration of covenants, conditions, and restrictions which I cannot find anywhere even their site. I also maintain my lawn very nice but obviously not nice enough to someone's liking !!!! How do I go about dealing with this ????
What does it mean when the Condo Association is in Bankrupcy? the realtor said the judge had ordered everyone to pay double condo fees, So instead of $381, its $762. My question is, if I'm interested in buying the condo, what's better that they pay the closing cost of around $4-$5K or that he pays the extra of $381 per month for the next year? The realtor also said that management had told him that it would only last another 3 months that they have to pay the extra $381.

How do I fight reverse age discrimination by my homeowners association? My fiance and I recently moved into a condo in Scottsdale. We are 32 yrs old. Most residents are 60+ yrs old. For several months we've been subjected to continual harrassment by the HOA board president. She patrols the complex daily & individually directs the management company’s actions. So far, I’ve had: - My residence status challenged on several occasions ("do you really live here?") when playing tennis; - My portable tennis ball machine (and me) accused of damaging the antiquated tennis court (which is false); - My brother-in-law & his kids chased out of the community park for playing wiffle ball ("We just put in new grass" - false - "it's not allowed" - also false) Two days ago, she jumped in front of my friend's moving car & accused him of speeding. She berated him for his “fast car” & then threatened to fine me! I just received the “violation” letter. This is not a 55+ community, but the board president is making us feel unwelcome. What can we do to fight back?
